Overview
Contemporary Amperex Technology Limited (CATL), or Ningde Shidai 宁德时代 is a Chinese battery maker and a major manufacturer of lithium-ion batteries for electric vehicles. It is currently a supplier for Tesla’s EVs and also has partnerships with other leading car brands such as Honda, Hyundai, BMW, Daimler, Toyota, Volkswagen, and Volvo. CATL also has a number of partnerships in China, including with leading brands like Geely and BAIC. CATL remains the leading battery producer for EV companies, but competitors such as LG, CALB, Panasonic and BYD have eaten into its market share in recent years.
Headquartered in Ningde, Fujian, CATL was listed in Shenzhen in 2018, and in June of 2022 it raised $6.7 billion in a Shenzhen stock offering. The company has an R&D center and base in Germany and subsidiaries in Japan, France, and the U.S. In August 2022, the company announced it would build a $7.6 billion battery plant in Hungary, which will be Europe’s largest EV battery plant. Although CATL was established only in 2011, the founding team has been involved in the lithium-ion battery business since 1999 under the company ATL.

DUE DILIGENCE
Sustainability
CATL’s Corporate Sustainability Management Committee is an ESG management structure with 5 system co-presidents as members that aims to ensure the efficient implementation of ESG work. CATL’s 2021 ESG report includes sections on management and administration, green development, sustainable supply chain, products and services, environmental protection, development of employees, and social contribution. Among the company’s accomplishments in green development is the certification by SGS of the new energy industry’s first fully carbon neutral production plant in the world. According to the report, CATL carried out water saving and packaging materials reduction campaigns in 2021. CATL also carries out due diligence around its supply chains in order to manage and reduce risks involved in sourcing minerals from conflict areas.
Legal Proceedings
CATL has been involved in 74 legal cases. In 35 of these cases it was the plaintiff and in 31 it was the defendant. 70 of the cases were civil litigations, while the remaining four were enforcement cases brought to ensure defendants complied with past sentences. A significant portion of CATL’s litigation activity is related to patent infringement suits. CATL has sued various battery-makers over patent infringement, including Chinese competitors like Tafel New Energy Technology and the state-owned CALB. CALB, a major player in the industry ranking third in terms of market share of installed capacity, most has been sued by CATL for hundreds of millions of yuan over patent infringement allegations.
Competitive Landscape
CATL has a lead over its competitors in the EV battery market, but is beginning to face stiff competition from Korean, Japanese and other Chinese firms. Companies like Panasonic, BYD, CALB and subsidiaries of Samsung and LG are all increasing the installed capacity of their battery products, and are trying to lure clients away from CATL. With the COVID-19 pandemic stressing supply chains and creating chip shortages, automakers are looking to secure sourcing for various car parts, including batteries. In 2021, Chinese carmaker NIO ended a four-year exclusive partnership with CATL with plans to diversify its battery suppliers. Tesla, meanwhile, announced it would partner with BYD for battery supply, and GM is pursuing a partnership with LG to build its own battery plants in the US.
